WIZCART INTELLECTUAL PROPERTY COMPLAINT POLICY

Owner: Wizcart Technologies Incorporated

This Intellectual Property Complaint Policy is issued by WIZCART TECHNOLOGIES INCORPORATED, a British Columbia corporation (corporation number BC1541387, incorporated 27 May 2025 under the BC Business Corporations Act) extra-provincially registered to carry on business in Alberta (Alberta corporate access number 2128144090) ("Wizcart", "we", "us", or "our"). Wizcart operates the Wizcart technology marketplace platform in Canada. Public legal notices, operational correspondence, and mailing communications may be sent to Wizcart at 903 8 Ave SW Office - 931, Calgary, AB T2P 0P7, Canada.

This Policy explains how to report alleged intellectual-property infringement on the Platform, including Canadian copyright notice-and-notice, trade-mark complaints, content complaints, and domain-name issues.

1. Wizcart Trade-mark Notice

The WIZCART word mark is a registered Canadian trade-mark owned by Wizcart Technologies LLC (CIPO Registration TMA1136312; Madrid Protocol International Registration 1504976). The mark is also registered in the United States as USPTO Registration 6,222,464. Wizcart Technologies Incorporated uses the WIZCART trade-mark in Canada under licence from Wizcart Technologies LLC pursuant to section 50 of the Trade-marks Act (Canada). Quality control over the use of the trade-mark in Canada is exercised by Wizcart Technologies LLC as the owner.

2. Canadian Copyright Notice-and-Notice

For Canadian copyright notices, Wizcart follows the notice-and-notice framework in the Copyright Act (Canada), where applicable. A copyright owner may send a notice of claimed infringement to legal@wizcart.com with sufficient information to identify the allegedly infringing material, the copyright work, the claimant, and contact information required by law.

Where the Canadian notice-and-notice regime applies and a notice meets statutory requirements, Wizcart may forward the notice to the person associated with the allegedly infringing electronic location and retain records that allow the identity of that person to be determined for six (6) months, or one (1) year if proceedings are commenced and Wizcart is notified as required by law. Canadian notice-and-notice is a notice-forwarding process and does not automatically require removal of the content.

3. Trade-mark Complaints

To report trade-mark infringement, email legal@wizcart.com with: the trade-mark at issue and registration number if any; the specific Platform content, URL, profile, or screenshot; your contact information; and a statement of your good-faith belief that the use is unauthorized. Wizcart may remove or disable content that it reasonably believes infringes trade-mark rights or violates Platform terms.

4. Domain-Name Disputes

Domain-name disputes involving the WIZCART mark may be handled under applicable domain-name policies, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP) for generic top-level domains and the CIRA Domain Name Dispute Resolution Policy (CDRP) for .ca domains. Wizcart Technologies Incorporated, as Canadian licensee of the WIZCART mark, may pursue appropriate domain-name remedies where authorized.

5. Response to a Complaint

If your content has been the subject of a copyright or trade-mark complaint that has been forwarded to you by Wizcart, you may respond by emailing legal@wizcart.com with: your name and contact information; the specific content at issue and its location; a description of your good-faith basis for using the content (for example, you own the rights, you have a licence, you are using the material lawfully under fair-dealing or another defence); and any supporting evidence. Where you contest a trade-mark complaint, you may also contact the claimant directly. Canadian copyright notice-and-notice is a notice-forwarding mechanism that does not automatically require removal; Wizcart's content-removal decision in a trade-mark or other context is based on Wizcart's reasonable assessment under this Policy and Platform terms.

6. Repeat Infringers and False Notices

Wizcart may suspend, restrict, or deactivate accounts of repeat infringers or users who submit infringing content, subject to applicable law and Platform terms. Knowingly false or misleading notices, counter-notices, or trade-mark complaints may create legal liability.
